Interesting case, at least to me.

The prior prosecutor publicly said they wouldn't prosecute, and the Court held that Cosby relied on that statement, but not a promise to him directly, in his testimony in a civil case that was then used against him when the new prosecutor did prosecute the case. They ruled the evidence from his testimony inadmissible b/c he relied on that "deal" with the prosecutor otherwise he wouldn't have testified in the civil case and incriminated himself.

So a due process wrong was committed, but no one seems to dispute that he did it.

When we debated the justice topic, the "Exclusionary Rule" was a hot topic, and it was proposed at the time that it be changed so you didn't release criminals but rather that they were otherwise compensated for the violation of their due process rights.

For example, the state of Penn. could be sued for the violation, but Cosby wouldn't get out of his criminal sentence b/c of it.
